March 20, 2026 – A federal judge in Washington ruled that parts of the Pentagon’s press restrictions violate the First Amendment and ordered the department to restore press passes for seven New York Times journalists. The journalists had surrendered their credentials rather than sign a policy that empowered the Pentagon to declare journalists “security risks” and revoke press access for conduct the department deemed threatening to national security.
Judge Paul Friedman wrote that the policy rewarded reporters who were “willing to publish only stories that are favorable to or spoon-fed by Department leadership,” and concluded the Pentagon had granted itself excessive discretion to enforce the rules. The policy took effect in October and drew condemnation from mainstream outlets; dozens of journalists turned in their Pentagon passes rather than agree to the restrictions. The Defense Department then credentialed a new set of media members, many described as pro-Trump commentators or influencers.
The structural signal is First Amendment constraint enforcement on executive information control. When agencies condition access on compliant coverage or restrict routine newsgathering practices, courts can intervene to limit discretionary exclusion and preserve protections for independent reporting. The Justice Department had asked the court to return the rules to the Pentagon for revision rather than vacate the disputed provisions; it was unclear whether the government would appeal.
The open question is whether the Pentagon revises its press policy in a narrower form or whether similar credential-and-access restrictions appear elsewhere across federal agencies as a tool for shaping information flow during crisis and wartime operations.
